| 内容記述 | Family practices in Japan are have to be registered with the Koseki family registration system. The term “no family register” used in this paper refers to the situation in which there are children who are not on the family register because those who must report the birth of the child do not report it for some reason. Although efforts to address this situation have been made since the Showa period, it was in the middle of the Heisei period that unregistered households were taken up as one social problem and a certain policy was taken. Why did this take so long? How did this process occur? This paper focuses on the so-called “300-day problem after divorce”, which is a major reason why children not included on the family register are born, and the policy-making process that took place from 2006 to 2008. This analysis is based on documentary materials and key informant interviews, and the arguments made by advocates for reform in the media and legislature. It was suggested that, during the discussion of the policy, it resulted in the rise of counter-claims, which led to a ‘solution’ different from the demands of advocates for reform. | |||||

| 内容記述 | 国民登録制度としての戸籍制度は、家族に関わる実践や意識のあり方と密接に関わってきた主要制度のひとつである。本稿で扱う「無戸籍」とは、子の出生の届出をしなければならない者が何らかの理由によってその届出をしないため、戸籍に記載されない子が存在する事態を指す。事態への対応を訴える動きは昭和期からみられたものの、無戸籍がひとつの社会問題として取り上げられ一定の政策対応がなされるのは平成期半ばのことであった。本稿は、戸籍のない子どもが生みだされる大きな理由であるいわゆる「離婚後300日問題」をめぐり2006年から2008年にかけて展開された政策決定過程を対象とし、無戸籍がこの時期いかにして、いかなる社会問題として構築されたのかを、立法府における動きとレトリックを中心に明らかにする。文書資料およびキーインフォーマントインタビューに基づく分析から、無戸籍を子どもの福祉上の問題とする、運動とメディア双方に共有されたレトリックが、「離婚後300日問題」の政策課題化を後押しすると同時に、政策が議論される中で結果的に対抗クレイムに力を与えることとなり、運動の要求とは異なる「解決」につながったことが示唆された。 | |||||
